CASE STRATEGY DEVELOPMENT – A STEP (OR THREE) AHEAD
While it’s a tautology to admit that every case is different, Inter-State Investigative Services follows a time-tested philosophy of working with each attorney with an open mind so as to determine the best strategy for the client on a case-by-case basis. Determining the wisest case strategy depends on many factors. But no matter how unique the case may be, we strive to stay ahead of the prosecution every step of the way.
WINNING STRATEGIES ARE EVIDENTIARY AT THEIR CORE
Working closely with our clients, we establish what evidence the prosecution has and how they are going to present their case. Every particular defense is different depending on the details of the case. However, most defenses fall into one of several categories:

- Denial
- Admission
- Confession
No matter which of these categories the defense falls into, our investigators work closely with counsel to ready all evidence and witnesses to prove our side’s case and/or disprove the prosecution’s side. Unfortunately, it’s rarely simply about telling “the truth” but, rather, working with the facts that are going to be accepted into evidence. This means having a superior grasp on the credibility of witnesses and the potential persuasiveness of salient evidence.
When developing a defense strategy, we work with the defense attorney to determine the credibility of defense and prosecution witnesses, community attitudes toward the crime and the defendant, and the nature of the prosecution’s evidence. Thus, winning strategies are developed on the evidence. And evidence is what our investigators are experts at finding, evaluating, and debunking.
A STRATEGY INGRAINED IN PROOF BEYOND A REASONABLE DOUBT
Inter-State Investigative Services believes wholeheartedly in our system of justice. The “Reasonable Doubt” Standard is a fundamental part of our democracy and it is part of what drives our approach to case strategy.
The most common defense is that the prosecution failed to prove the defendant guilty beyond a reasonable doubt. Raising questions about the credibility of the prosecution’s witnesses can create reasonable doubt in the minds of the jurors so they will acquit the defendant. To cast doubt on the truthfulness and reliability of prosecution witnesses, we work with defense attorneys to:
- Demonstrate bias on the part of prosecution witnesses, who, therefore, may be lying.
- Expose police mistakes in gathering, maintaining, and testing physical evidence.
- Challenge the believability of a witness’ story on the grounds of logic or common sense.
